These Terms and Conditions (hereinafter, "the Conditions") govern the contractual relationship between GOLDEN NUGGETS, SLU (hereinafter, "the Company") and any natural or legal person (hereinafter, "the User" or "the Client") who contracts one or more of the services of the Kooby ecosystem, accessible through www.kooby.io.
The Kooby ecosystem is composed of the following services, contractable independently or jointly:
Contracting of the services is carried out entirely through the Website through the following steps:
SaaS for integral business management.
SaaS point-of-sale.
SaaS predictive booking engine.
Joint contracting of the three SaaS with a discount over standalone pricing.
Hardware device required for the operation of Kooby POS at the User's premises. It is sold as a one-time payment, the amount of which is communicated to the User during the contracting and demo process. The device is delivered and configured during onboarding. The warranty is 24 months from the date of delivery, under the terms provided by applicable consumer regulations.
Prices may be modified by the Company. Any change will be communicated to the User with a minimum of 30 days' notice before its application in the next billing cycle. The User may cancel the subscription before the application of the new price without cost or penalty.
Kontrola includes up to 3 venues under the same account. Each additional venue from the fourth onwards is billed at €14.95/month (VAT not applicable in Andorra). It is activated and deactivated from the user panel with effect on the next billing cycle; it is prorated by days in the month of activation.
Payments are processed securely through the Monei payment gateway. The Company does not directly store User credit or debit card data. SaaS subscriptions renew automatically at the end of each billing period (monthly or annual), unless the User cancels the subscription before the renewal date. Payment for the Kooby Connect Box is one-time and does not renew.
In accordance with article 103.m) of Royal Legislative Decree 1/2007, a User who qualifies as a consumer has a period of 14 calendar days from the contracting of the digital services to exercise their right of withdrawal without justification.
However, if the User has expressly consented to the beginning of the provision of the digital service during the withdrawal period and acknowledges that they thereby lose their right of withdrawal, such right may not be exercised once the provision has begun.
For the Kooby Connect Box, the User has 14 calendar days from receipt of the device to exercise withdrawal, provided that the product is returned in its original packaging, unused and unsealed, and in perfect condition. Device return costs are borne by the User.
Where withdrawal is applicable, the Company will refund the User the full amount paid within a maximum period of 14 calendar days from receipt of the request (or from receipt of the returned device, as applicable), using the same means of payment used for the initial transaction.
To exercise the right of withdrawal, the User must communicate it unequivocally by sending an email to hola@kooby.io.
The User may cancel any of their SaaS subscriptions at any time from their user panel within the application or by contacting hola@kooby.io. Cancellation takes effect at the end of the current billing period. There is no minimum lock-in.
Kontrola, Kooby POS and Kooby Bookings are digital services (SaaS) provided entirely online. The Company guarantees a service availability of 99.5% monthly, excluding scheduled maintenance periods. The Kooby Connect Box is a physical product and its delivery is governed by clause 3.5 and applicable consumer regulations.
Data entered by the User in the platforms (ingredients, recipes, prices, suppliers, sales, customers, bookings, etc.) are the User's exclusive property. The Company acts as data processor of said data with the sole purpose of providing the contracted services.
In the event of account cancellation, the User will have a period of 30 days to export their data before its definitive deletion from the servers.
Kooby services are management, sales, booking and analytical tools. The Company does not guarantee specific economic results derived from the use of the platforms. The recommendations provided by the artificial intelligence assistants and predictive engines are indicative and do not constitute professional financial, tax or legal advice.
The Company reserves the right to modify these Terms at any time. Substantial modifications will be communicated to the User with a minimum of 30 days' notice.
These Terms are governed by the laws of the Principality of Andorra, without prejudice to the rights that correspond to the User as a consumer under the mandatory legislation of their country of residence, in particular Royal Legislative Decree 1/2007 for users residing in Spain.
